LEONIA RETIREMENT HOUSING CORP (LRHC) welcomes you to our esteemed retirement community, dedicated to fostering a vibrant, secure, and supportive environment where every resident can thrive. These Terms and Conditions (the “Agreement”) constitute a comprehensive, legally binding contract governing the residency of all individuals and couples (referred to herein as the “Resident” or “Residents”), the use of all community facilities, and the provision of services by LRHC. By executing the separate Residency Agreement and commencing residency at 270 GLENWOOD AVE, LEONIA, NJ 07605 US, the Resident, along with their authorized representatives and family members, agrees to be fully bound by all clauses, policies, procedures, and rules detailed within this document, and any subsequent, properly communicated amendments. This Agreement is designed to ensure clarity, equity, and the maintenance of a high-quality, harmonious living environment for all members of the LRHC community. It establishes mutual rights and responsibilities, detailing expectations related to financial obligations, community conduct, safety protocols, service access, and dispute resolution, all administered with the professional integrity and compassion inherent in our organizational mission. Residents are strongly advised to review these Terms and Conditions in their entirety, and to consult with legal counsel or authorized family representatives concerning all provisions prior to final acceptance.
I. Residential and Financial Obligations
Defining the Contractual Relationship and Financial Clarity
A. Residency Agreement and Term
The right of residency at LEONIA RETIREMENT HOUSING CORP is granted exclusively upon the execution of a separate, formal Residency Agreement, which outlines the specific unit assigned, the initial monthly fee, and the primary term of occupancy. This Residency Agreement is incorporated by reference into these Terms and Conditions. The residency term typically commences on the agreed-upon move-in date and continues on a month-to-month basis thereafter, unless otherwise specified in writing. To ensure a predictable and stable environment, termination of the Residency Agreement by the Resident requires not less than sixty (60) days written notice to the LRHC administrative office, regardless of the reason for termination. Failure to provide this mandatory notice may result in the forfeiture of the security deposit or the assessment of a termination fee equivalent to one month’s rent. LRHC reserves the right to terminate residency only under specific, documented circumstances as outlined in Section III, strictly adhering to all applicable New Jersey state landlord-tenant and senior care regulations, always prioritizing the safety and welfare of the community.
B. Monthly Service Fees and Payment Structure
Residents are obligated to pay the predetermined monthly service fee, which is due in full on the first day of each calendar month and is considered delinquent if not received by the fifth day of the month. This fee encompasses the residential unit occupancy, utility consumption (excluding premium services not provided by the community), access to all common areas and amenities, standard housekeeping and maintenance services (managed by James O’Connell’s team), and participation in the core Lifestyle Enrichment Curriculum and social activities (managed by Sarah Jenkins). Late payment fees will be assessed on any outstanding balance not received by the fifth day, calculated as a percentage of the outstanding balance or a flat fee, as defined in the separate Fee Schedule provided at enrollment. While LRHC accepts various forms of payment, the Resident acknowledges that the most efficient method is automated electronic funds transfer, which requires the submission of accurate financial information (SPI). Any dishonored payments (e.g., returned checks or failed electronic transfers) will incur an administrative processing fee. Service fees are subject to periodic, typically annual, adjustment to reflect changes in operating costs, inflation, and service enhancements, with all Residents receiving a minimum of thirty (30) days advance written notice of any fee increase.
C. Security Deposit and Financial Guarantees
Upon execution of the Residency Agreement, the Resident is required to provide a security deposit equivalent to a specified number of months of the monthly service fee, as detailed in the separate financial disclosures. This security deposit is held by LRHC in a dedicated, non-commingled account, in compliance with state law, and may be used by LRHC only to cover unpaid monthly service fees, costs associated with documented physical damage to the residential unit beyond normal wear and tear (as assessed by the Facilities Director), or unreimbursed personal support charges incurred upon the termination of residency. This deposit is not considered a payment for the final month of residency. Following the termination of residency and the completion of all required move-out procedures, the unused portion of the security deposit will be returned to the Resident or their authorized financial representative, along with a detailed accounting of any deductions, within the timeframe mandated by New Jersey law, ensuring financial transparency and prompt resolution of the final account balance.
II. Community Conduct and Safety Policies
Establishing Clear Standards for a Harmonious and Secure Living Environment
A. Resident Code of Conduct
All Residents are expected to conduct themselves in a manner that respects the rights, peace, and dignity of all other residents, staff, and visitors, upholding the LRHC value of compassion. Conduct that is abusive, harassing, threatening, discriminatory, or disruptive to the general harmony and operation of the community is strictly prohibited and constitutes a breach of these Terms and Conditions. This includes excessive noise, disruptive behavior in common areas, verbal or physical aggression toward any individual on the premises, or interference with staff duties. Residents must comply with all posted rules for the use of communal spaces, including the dining hall, fitness area, and activity rooms, ensuring equitable access for all. Repeated or severe violations of the Resident Code of Conduct, as documented by the Residential Care Manager or Community Life Director, will lead to progressive disciplinary action, up to and including the issuance of a notice of termination of residency.
B. Safety, Security, and Emergency Protocols
The safety of our residents is paramount, and every Resident must adhere to all established LRHC safety and emergency protocols, which are regularly communicated and posted throughout the facility. Residents are required to utilize the in-unit emergency call system for all urgent needs, medical issues, or security threats, understanding that misuse of this system may result in administrative action. Smoking is strictly prohibited within all interior common areas and residential units to comply with fire safety regulations and to protect the health of all residents. Residents may not possess illegal substances or firearms on the premises. Residents must comply with fire alarm procedures, which include evacuation or shelter-in-place instructions during drills or actual emergencies. While LRHC provides 24/7 staff presence and perimeter security, the Resident remains solely responsible for the security of their personal belongings within their unit, and LRHC is not liable for loss or damage of personal property not caused by the negligence of LRHC staff or a failure of facility infrastructure maintained by the Operations team.
C. Visitor and Guest Policy
Residents are welcome to host guests and visitors, including family and authorized representatives, reinforcing the feeling of an open and supportive home environment. However, all visitors must abide by the Resident Code of Conduct and must be accompanied by the Resident while utilizing any communal areas, respecting the privacy and security of the community. All visitors must sign in and sign out at the main reception desk to ensure facility security and proper accounting in the event of an emergency evacuation. Guests may stay overnight in a Resident’s unit for a cumulative maximum of seven (7) consecutive nights or fourteen (14) total nights within any calendar month, unless prior written authorization is explicitly granted by the administration for extended stays, which may incur a nominal fee for services like additional meals or linen use. The Resident is fully responsible for the actions and compliance of their guests at all times, and any guest violation of these Terms and Conditions will be treated as a violation by the Resident.
III. Health, Wellness, and Care Coordination
Detailed Management of Personalized Support and Health Information
A. Disclosure of Health Information and Care Needs
By entering into the Residency Agreement, the Resident agrees to provide truthful, comprehensive, and continuous disclosure of all necessary health, medical, and psychological information required to safely and effectively coordinate their living and potential supportive care services, adhering to our value of integrity. This includes sharing relevant medical history, current diagnoses, medication lists, and the contact information for all primary and specialty physicians (e.g., Dr. Alistair Chen). The Resident acknowledges that this Health and Wellness Data is vital for the Residential Care Manager, Maria Rodriguez, to develop a comprehensive, personalized care plan and to ensure appropriate emergency response. LRHC reserves the right to request updated medical assessments from a licensed physician at any time if there is a documented, material change in the Resident’s physical or cognitive condition that may impact their ability to live safely and independently within the current level of services provided by the community.
B. Supportive Services and Level of Care Adjustments
LRHC is an independent retirement housing community that offers access to supportive services through licensed external agencies or through coordination with our Wellness Coordinator, but it is not a licensed skilled nursing facility. The level of care a Resident requires will be assessed periodically by the Residential Care Manager. If the Resident’s care needs exceed the scope of services that can be reasonably and safely provided within the community’s capabilities and staffing structure, or if the Resident’s condition poses a documented threat to the health or safety of themselves or other residents, LRHC reserves the right to require the Resident to obtain additional external services at the Resident’s expense. Should the Resident’s needs perpetually exceed what can be legally or safely managed within the independent living setting, the Resident may be required to transfer to a more appropriate care setting, and LRHC will provide reasonable assistance and notice during this transition period, upholding the highest standards of compassionate care throughout the process.
C. Medication Management and Emergency Authorization
The Resident is primarily responsible for the self-administration and secure storage of all their prescribed medications within their private unit, maintaining personal responsibility for their health regime. While the Residential Care Manager may coordinate with external pharmacies and provide medication reminders as part of a supportive service package, LRHC staff are generally not authorized to directly administer prescription medications unless specifically licensed and contracted to do so under a formal care addendum. In the event of a medical emergency where the Resident is incapacitated or unable to communicate, the Resident grants LRHC staff, including the Residential Care Manager, immediate authorization to contact emergency medical services, provide relevant Health and Wellness Data to first responders, and facilitate transport to the nearest appropriate medical facility, ensuring prompt and necessary care is delivered without delay.
IV. Use of Facilities, Amenities, and Intellectual Property
Rules Governing Community Resources and Resident Engagement
A. Use of Common Areas and Amenities
All Residents are encouraged to fully utilize the common areas, fitness center, communal dining room, and activity spaces provided for social engagement and recreation, which form the core of our vibrant community experience. Access to these amenities is contingent upon adhering to all posted rules, hours of operation, and any safety guidelines established by the Community Life Director, Sarah Jenkins, or the Facilities Director. Residents must refrain from unauthorized use of commercial equipment, must adhere to dress codes in public areas, and must not reserve or monopolize communal resources for private use without prior administrative approval. Damage caused to any common area or shared amenity by a Resident or their guest beyond normal wear and tear will be assessed and billed to the responsible Resident for repair or replacement, ensuring the facilities remain in excellent condition for the benefit of all members of the community.
B. Participation in Programs and Activities
The Lifestyle Enrichment Curriculum, which includes educational seminars, wellness classes (e.g., chair yoga), group outings, and cultural events, is provided for the sole enjoyment and benefit of Residents. While participation is encouraged for holistic well-being, attendance at all non-medical activities is voluntary. LRHC reserves the right to modify, cancel, or substitute any scheduled program or activity without prior notice if necessary due to weather, instructor availability, or insufficient enrollment, always striving to offer a diverse and engaging alternative. Residents participate in all physical activities and excursions, particularly those managed off-site, entirely at their own risk, acknowledging the inherent risks of such activities, and are required to sign specific waivers for higher-risk activities or travel outside the Leonia area, releasing LRHC from liability for injuries not caused by its direct negligence.
C. Intellectual Property and Photography Use
In the course of fostering community engagement, LRHC staff, particularly the Community Life Director, may take photographs or videos of activities, social events, and programs. The Resident, by accepting these Terms and Conditions, grants LRHC a non-exclusive, royalty-free license to use any such photographs or video footage featuring the Resident for the sole purpose of internal newsletters, community bulletin boards, promotional materials, or general content on the LRHC website (info@lrhc.site), showcasing the active retirement lifestyle provided. Residents maintain the right to formally opt-out of all photographic consent by providing a written request to the administrative office upon move-in or at any time thereafter, and LRHC will make reasonable efforts to exclude the Resident from future publicly used media, respecting their privacy wishes. Any media taken for commercial use or distribution outside of standard community promotion will require a separate, explicit written consent from the Resident.
V. Termination, Dispute Resolution, and Governing Law
Protocols for Concluding Residency and Addressing Conflicts
A. Termination of Residency by LRHC
LEONIA RETIREMENT HOUSING CORP may terminate a Resident’s occupancy and services only for Good Cause, as defined by New Jersey state law and documented in the Residency Agreement, which includes, but is not limited to: 1) Failure to pay the monthly service fee when due; 2) Repeated or serious violations of the Resident Code of Conduct that endanger the health, safety, or welfare of other residents or staff; 3) Material breach of any term or condition of this Agreement; 4) A change in the Resident’s health status that makes continued residency at LRHC medically or legally inappropriate given the available level of care, as certified by a licensed physician and the Residential Care Manager. In the event of an involuntary termination for cause, LRHC will provide the Resident with a written Notice of Termination, adhering to all mandatory notice periods and due process rights required by New Jersey regulations, allowing the Resident and their representatives a period to cure the violation or arrange for a smooth and dignified departure from the community.
B. Dispute Resolution and Arbitration Agreement
Any dispute, controversy, or claim arising out of or relating to this Residency Agreement, these Terms and Conditions, or any services provided by LEONIA RETIREMENT HOUSING CORP, including, but not limited to, claims of breach, negligence, violation of statutory rights, or financial disagreement, shall first be subjected to mandatory non-binding mediation in Leonia, New Jersey, with a mutually agreed-upon neutral third-party mediator, in an effort to find a fair, amicable resolution and avoid costly litigation. If mediation fails to resolve the dispute, the parties agree that all unresolved claims, except for those specifically excluded by law (such as evictions or certain health-related administrative appeals), shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in New Jersey, under its applicable rules. By agreeing to binding arbitration, the Resident and LRHC knowingly and voluntarily waive their right to a trial by jury for the resolution of covered disputes. The decision of the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction, providing a definitive, albeit formal, mechanism for conflict resolution.
C. Governing Law and Severability
These Terms and Conditions, the Residency Agreement, and the relationship between the Resident and LEONIA RETIREMENT HOUSING CORP shall be exclusively governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws principles. The parties agree that the venue for any legal action permitted to be filed outside of arbitration shall be exclusively in the state or federal courts located in Bergen County, New Jersey. If any provision of this Agreement or the Residency Agreement is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, or unenforceable, that provision shall be severed from the remainder of this Agreement, which shall remain in full force and effect. The severance of such provision shall not affect the validity or enforceability of the remaining provisions, ensuring the contractual obligations of both the Resident and LRHC continue to guide the relationship and maintain the operational stability of the community.
